      <title>How Do I Become A Process Server?</title>

Becoming a process server is a rewarding career if you&amp;#39;re honest, 
		   hardworking, and reliable.  So where do you begin?

		   First, you need to understand what a legal process server does.  A process server is hired by attorneys 
		   and legal support teams from across the country, that need legal documents served to individuals.  It is then the 
		   responsibility of the process server, to properly serve the documents while abiding by the originating states laws 
		   governing the service of process.

		   Second, you need to understand the laws.  Some states require you to be licensed, some states do not.

      <title>SON SERVES 98-YEAR-OLD MOTHER WITH EVICTION NOTICE ON HER BIRTHDAY</title>

She still pays all her bills with her Social Security money, WTNH reported, but that didn’t stop Peter Kantorowski, 71, from serving his mother with papers in December.&lt;/div&gt;&lt;div id="ctrl-8209791"&gt;&lt;br&gt;&lt;/div&gt;&lt;div id="ctrl-8209793"&gt;He told the Post the move is meant to be for his mother’s own good.&lt;/div&gt;&lt;div id="ctrl-8209794"&gt;&lt;br&gt;&lt;/div&gt;&lt;div id="ctrl-8209796"&gt;“She would be better off living with people her own age,” Peter Kantorowski, a retired taxidermist, said.&lt;/div&gt;&lt;div id="ctrl-8209797"&gt;&lt;br&gt;&lt;/div&gt;&lt;div id="ctrl-8209799"&gt;Peter Kantorowski told WTNH his mother has fallen a few times and worries about her safety and security, though he admitted he hasn’t actually been to see her in eight months.&lt;/div&gt;&lt;div id="ctrl-8209800"&gt;&lt;br&gt;&lt;/div&gt;&lt;div id="ctrl-8209802"&gt;According to the Post, a judge went and visited Mary in her house, and following an examination by a geriatric specialist, ruled her competent to handle her own affairs and assigned attorney Richard Bortolot as a voluntary conservator. Within weeks of serving his mother with the eviction notice, Peter Kantorowski attempted to put the house up for sale — a move that was stopped in court proceedings.&lt;/div&gt;&lt;div id="ctrl-8209803"&gt;&lt;br&gt;&lt;/div&gt;&lt;div id="ctrl-8209805"&gt;“I’ve been practicing a long time, and I’ve seen a lot of nasty things and this is, you know, he’s really made the top ten list,” Bortolot told WTNH.&lt;/div&gt;&lt;div id="ctrl-8209806"&gt;&lt;br&gt;&lt;/div&gt;&lt;div id="ctrl-8209808"&gt;Mary Kantorowski‘s other son Jack told the station he’s appalled by what his older brother is doing. When you'd walk up to the house he'd close the drapes and wouldn't answer the door,&amp;quot; Palmer said. &amp;quot;We tried to serve him four times before.&amp;quot;&lt;br&gt;&lt;br&gt;Since Stewart had previously refused to open the door, the court had granted an alternate means of service to post the papers on the front gate and mail them, Palmer said.&lt;br&gt;&lt;br&gt;The server told police and Palmer that he taped the paperwork to the locked front gate and was walking back to his vehicle when Stewart stepped out of his home and shot him with a handgun, Palmer said. The server made it back to his vehicle and called 911.&lt;br&gt;&lt;br&gt;The victim was shot once in the lower right side of his abdomen and was taken to Yavapai Regional Medical Center for treatment for non-life-threatening injuries, said Lt. Andy Reinhardt, &lt;font color="#0066cc"&gt;Prescott Police Department&lt;/font&gt; spokesman.&lt;br&gt;&lt;br&gt;&amp;quot;After we responded to the scene, officers called Stewart, and he came out of his residence within 10 minutes and was arrested,&amp;quot; Reinhardt said. &amp;quot;Stewart refused to talk to officers after his arrest.&amp;quot;&lt;br&gt;&lt;br&gt;Reinhardt said SWAT was not called out for the incident.&lt;br&gt;&lt;br&gt;Palmer said a police detective came by his office Monday morning to get a copy of the paperwork that had been taped to the gate, because it was found ripped up at the scene.&lt;br&gt;&lt;br&gt;&lt;/font&gt;&lt;/div&gt;&lt;/div&gt;

The plane crashed southeast of Pittsburgh in Somerset County, Pennsylvania. The plan  was carrying 37 passengers and 7 crew members. There were no survivors.  Todd Beamer, a passenger, tried to place a credit card call but was routed to a customer service representative instead, who passed him on to supervisor Lisa Jefferson. She called the FBI. Beamer reported that one passenger was dead.  He asked if together they could pray the Lord's prayer, which they did.  Later, he told the operator that some of the plane's passengers were planning &amp;quot;to jump&amp;quot; the hijackers. The last words Ms. Jefferson heard from the plane were &amp;quot;Are you ready guys? Let's roll.&amp;quot;  The plane crashed into a field near Shanksville, Pennsylvania at 10:03 AM, killing all aboard.       <title>Aurora Colorado Process Server</title>
      <description>&lt;table cellpadding="0" cellspacing="0" border="0" id="tabcolumn-1" style="width: 100%; margin-bottom: 15px"&gt;&lt;tr&gt;&lt;td&gt;&lt;div id="column-1" usermodifiable="true" style="width: 100%"&gt;&lt;div id="ctrl-14805461"&gt;&lt;font size="2"&gt;&lt;b&gt;AURORA&lt;/b&gt; - A Colorado process server while attempting to discharge their official duties of serving legal notice was charged with two counts of misdemeanor assault and battery.&lt;/font&gt;&lt;/div&gt;&lt;div id="ctrl-14805462"&gt;&amp;#160;&lt;/div&gt;&lt;div id="ctrl-14805463"&gt;&lt;font size="2"&gt;Ellana DeLoach, a Colorado private process-server, while on duty April 27,2008 was attempting to serve legal notice on Quan Reeder at the Pacesetter Motel located at 14291 E. Colfax Ave. Unit #33.&lt;/font&gt;&lt;/div&gt;&lt;div id="ctrl-14805464"&gt;&lt;font size="2"&gt;According to the police report, DeLoach approached unit #33 and knocked on the door and waited. In DeLoach's statement she claims that she saw someone moving around inside the unit and refused to answer the door. Deloach continued to knock on the door until someone did answer.&lt;/font&gt;&lt;/div&gt;&lt;div id="ctrl-14805465"&gt;&amp;#160;&lt;/div&gt;&lt;div id="ctrl-14805466"&gt;&lt;font size="2"&gt;In Dennis Tavarres' , the occupant of unit #33, statement he claims that he was asleep and heard someone banging on his door for almost 20 minutes until he awoke enough to get up and answer the door. According to Tavarres, DeLoach demanded his ID and asked if he was Quan Reeder. Tavarres told Deloach that she wasn't the police and that he was not giving her any ID.&lt;/font&gt;&lt;/div&gt;&lt;div id="ctrl-14805467"&gt;&amp;#160;&lt;/div&gt;&lt;div id="ctrl-14805468"&gt;&lt;font size="2"&gt;According to this statement, DeLoach then threw the paperwork into the apartment and told him that he was served.&lt;/font&gt;&lt;/div&gt;&lt;div id="ctrl-14805469"&gt;&amp;#160;&lt;/div&gt;&lt;div id="ctrl-14805470"&gt;&lt;font size="2"&gt;Tavarres then picked up the papers and noticed the name on the documents and tried to approach DeLoach to tell her that he wasn't the person she was looking for and that he didn't know who she was looking for. &lt;/font&gt;&lt;/div&gt;&lt;div id="ctrl-14805471"&gt;&amp;#160;&lt;/div&gt;&lt;div id="ctrl-14805472"&gt;&lt;font size="2"&gt;In both statements both admit that DeLoach gave an order to &amp;quot;Don't come any closer.&amp;quot; According to the police statement, Tavarres complied and stopped about 4 feet away from DeLoach. Tavarres asserts that DeLoach then approached him and pushed him in the chest. &lt;/font&gt;&lt;/div&gt;&lt;div id="ctrl-14805473"&gt;&amp;#160;&lt;/div&gt;&lt;div id="ctrl-14805474"&gt;&lt;font size="2"&gt;Since she didn't take the paperwork Tavarres placed the documents on DeLoach's trunk of her car. Tavarres states that DeLoach then threw the paperwork off the car and drove away running over the documents.&lt;/font&gt;&lt;/div&gt;&lt;div id="ctrl-14805475"&gt;&lt;font size="2"&gt;According to the police statement Officer D. Chamberland observed the tire marks on the documents and took them into evidence. &lt;/font&gt;&lt;/div&gt;&lt;div id="ctrl-14805476"&gt;&amp;#160;&lt;/div&gt;&lt;div id="ctrl-14805477"&gt;&lt;font size="2"&gt;Officer Chambeland then questioned another resident, C. Riley, who stated that he witnessed the whole incident. Riley claims he saw a very aggressive black woman banging on unit #33's door for about 20 minutes. Riley stated in the police report that the pounding annoyed him to the point that he wanted to call the police.&lt;/font&gt;&lt;/div&gt;&lt;div id="ctrl-14805478"&gt;&amp;#160;&lt;/div&gt;&lt;div id="ctrl-14805479"&gt;&lt;font size="2"&gt;Riley added, that he could hear the incident from his location across the parking lot. He says that he could hear the lady telling Taverres that he was someone else and that he could see DeLoach throw the paperwork at Tavarres inside his unit. Riley watched and noticed Tavarres follow after DeLoach trying to give the documents back to her at her car.&lt;/font&gt;&lt;/div&gt;&lt;div id="ctrl-14805480"&gt;&amp;#160;&lt;/div&gt;&lt;div id="ctrl-14805481"&gt;&lt;font size="2"&gt;Riley heard DeLoach command &amp;quot;Don't come any closer&amp;quot; and that Tavarres stopped about 3 to 4 feet from DeLoach. Riley stated in his police statement that Tavarres had stopped sufficient distance away from DeLoach that Tavarres could not touch her even with his arms extended. &lt;/font&gt;&lt;/div&gt;&lt;div id="ctrl-14805482"&gt;&amp;#160;&lt;/div&gt;&lt;div id="ctrl-14805483"&gt;&lt;font size="2"&gt;Riley then added, DeLoach then approached Tavarres and pushed him. According to the statement Riley claims that DeLoach pushed Tavarres twice that he could remember. DeLoach then took the papers off her trunk of her car and threw them at Tavarres. &lt;/font&gt;&lt;/div&gt;&lt;div id="ctrl-14805484"&gt;&amp;#160;&lt;/div&gt;&lt;div id="ctrl-14805485"&gt;&lt;font size="2"&gt;Officer Chamberland then interviewed DeLoach at her home. DeLoach claims that she went to the motel and knocked on the door. DeLoach asserts that she observed someone in the unit moving around and continued to knock until someone answered.&lt;/font&gt;&lt;/div&gt;&lt;div id="ctrl-14805486"&gt;&amp;#160;&lt;/div&gt;&lt;div id="ctrl-14805487"&gt;&lt;font size="2"&gt;A man answered and refused to identify himself to her and she threw the paperwork on the floor inside of the apartment and told him he was served.&amp;#160; Even though he told her verbally that he was not the person she was looking for.&lt;/font&gt;&lt;/div&gt;&lt;div id="ctrl-14805488"&gt;&amp;#160;&lt;/div&gt;&lt;div id="ctrl-14805489"&gt;&lt;font size="2"&gt;DeLoach added this is a common practice for people to avoid being served, she dropped the paperwork and returned to her vehicle. While returning to her car she noticed that he (Tavarres) was following her, and commanded him &amp;quot;Don't get any closer.&amp;quot; DeLoach claims that she put her hand out to keep him away from her, but never touched him. &lt;/font&gt;&lt;/div&gt;&lt;div id="ctrl-14805490"&gt;&amp;#160;&lt;/div&gt;&lt;div id="ctrl-14805491"&gt;&lt;font size="2"&gt;According to the police statement DeLoach then retrieved the papers off her trunk and then placed them back inside the apartment, then drove away.&lt;/font&gt;&lt;/div&gt;&lt;div id="ctrl-14805492"&gt;&amp;#160;&lt;/div&gt;&lt;div id="ctrl-14805493"&gt;&lt;font size="2"&gt;In an interview between Officer Chamberland and DeLoach's superior, he stated that the police could keep the documents with the tire marks on them as evidence and that he would just get another service set. Officer Chamberland stated that he could make another copy and release those to DeLoach. Mr. Mills stated that was not necessary. &lt;/font&gt;&lt;/div&gt;&lt;div id="ctrl-14805494"&gt;&amp;#160;&lt;/div&gt;&lt;div id="ctrl-14805495"&gt;&lt;font size="2"&gt;Mr. Mills of Sweepstakes Unlimited added that he has never had any problems with DeLoach, and that he didn't believe any of the allegations.&lt;/font&gt;&lt;/div&gt;&lt;div id="ctrl-14805496"&gt;&amp;#160;&lt;/div&gt;&lt;div id="ctrl-14805497"&gt;&lt;font size="2"&gt;Subsequently, Tavarres wanted to press charges against DeLoach and go to court due to being pushed.&lt;/font&gt;&lt;/div&gt;&lt;div id="ctrl-14805498"&gt;&lt;font size="2"&gt;DeLoach was charged with two counts of misdemeanor assault and battery.       <title>Process Server Trespass Issues</title>

Service of process is an extremely important step in the legal process, as it ensures that all parties have an equal opportunity to present a case. However, accepting the served documents obligates the recipient to participate in the proceedings or risk consequences. Some would-be recipients are aware of this fact and try to avoid accepting the documents. Responsibility then falls to the process server to ensure that the documents are properly served to the unwilling recipient. However, the process server must continue to follow all local, state and federal laws and procedures. One of the most confusing aspects can be trespass laws.&lt;/font&gt;&lt;/div&gt;&lt;div id="ctrl-15746310"&gt;&amp;#160;&lt;/div&gt;&lt;div id="ctrl-15746311"&gt;&lt;b&gt;Know the Law&lt;/b&gt;&lt;/div&gt;&lt;div id="ctrl-15746312"&gt;&lt;br&gt;Trespass laws vary dramatically between jurisdictions. As a process server, you are responsible for knowing exactly what you and are not permitted to do. Trespass laws are often fuzzy and difficult to interpret. It is always best to err on the side of caution and find another means of serving process.&lt;/div&gt;&lt;div id="ctrl-15746314"&gt;&amp;#160;&lt;/div&gt;&lt;div id="ctrl-15746315"&gt;&lt;b&gt;Gray Areas&lt;/b&gt;&lt;br&gt;&lt;/div&gt;&lt;div id="ctrl-15746317"&gt;In general, trespass laws apply to someone infringing on private property to which he or she has not been invited. Normally, approaching someone's front door in order to knock is not considered trespassing. However, if the property is fenced and gated, then climbing the fence or jumping the gate would be considered trespassing.&lt;/div&gt;&lt;div id="ctrl-15746318"&gt;What if the person lives in an apartment complex or gated community? Technically, the entire building or complex can be considered private property. How can you reach the person's individual residence?&lt;/div&gt;&lt;div id="ctrl-15746319"&gt;&amp;#160;&lt;/div&gt;&lt;div id="ctrl-15746320"&gt;The laws vary widely on this circumstance. In some jurisdictions, the property owner or manager is required to allow properly documented process servers to access the location. In some areas, receiving permission to enter the property from someone else who lives there, such as a neighbor, is sufficient. It is important to pay close attention to the specific laws that govern such matters in your area, and always seek legal advice if you are unsure.&lt;/div&gt;&lt;div id="ctrl-15746321"&gt;&amp;#160;&lt;/div&gt;&lt;div id="ctrl-15746322"&gt;&lt;b&gt;Is There an Alternative?&lt;/b&gt;&lt;/div&gt;&lt;div id="ctrl-15746323"&gt;&lt;br&gt;Due to vagaries and confusion of trespass laws, it is often best to simply avoid the situation. Research the would-be recipient's habits and movements carefully. You may find a more ideal situation in which to serve process. They mystery of who sent them, why they we're sent, and maybe even what kind of flowers? First we call the unknowingly sucker and let him/her know that are very lucky and obviously special to someone because they have been sent a boatload of beautiful flowers. But unfortunately the delivery has not succeeded previously and we would like to schedule proper delivery. After we schedule, our process server visits the location at the pre-determined time and provides the evasive defendant with a boatload of documents and some colorful flower stickers pasted on top.
